Alec Baldwin he will no longer face charges in the October 2021 shooting Rust cameraman Halyna Hutchinsová.
Special Prosecutor Kari T. Morrissey said Monday, Dec. 23, that an appeal to reinstate the charges against the actor, 66, was dropped due to insufficient support from the New Mexico district attorney’s office. The New York Times and CBS News.
Previous impeachment case against Baldwin fell apart in court in July when his lawyers successfully argued that the prosecution withheld evidence potentially connected to the case.
“The state’s efforts to continue to litigate in a fair and comprehensive manner have encountered numerous obstacles that have jeopardized its ability to prosecute to the full extent of the law,” Morrissey said in a news release. New York Times.
“The appeal would challenge the court’s dismissal of criminal charges against producer and actor Alec Baldwin involving involuntary manslaughter in the tragic shooting of cameraman Halyna Hutchins on the set of Rust on October 21, 2021,” the New Mexico First Judicial District Attorney’s Office said.
“The FJDA commends Morrissey for her work in prosecuting two cases of such magnitude and national attention, including the successful prosecution of Hannah Gutierrez Reed. FJDA supports the Hutchin family and their continued fight for justice in civil court,” the statement to CBS News added.
Baldwin Lawyers, Luke Nick and Alex Spirosaid the decision “to dismiss the appeal is the ultimate confirmation of what Alec Baldwin and his lawyers have been saying from the beginning – it was an unspeakable tragedy, but Alec Baldwin committed no crime. The rule of law remains intact in New Mexico.”
Baldwin has yet to comment publicly on the decision, but on Monday shared a link to a New York Times article about it via X.
Hutchins was killed and Rust director Joel Souza he was injured as a result of a prop gun containing a live bullet being fired during filming in October 2021. Hutchins’ family filed a wrongful death lawsuit against Baldwin in February 2022 and in October, he tied with the Emmy winner.
Baldwin, who denied pulling the trigger, was later charged with two counts of involuntary manslaughter in January 2023 and pleaded not guilty a month later. The charges were dropped in April 2023. However, he was charged with involuntary manslaughter and for the second time earlier this year and headed to court in July.
The case was released Judge of the First Judicial District Mary Marlowe Sommer in July. Sommer agreed with Baldwin’s attorneys that prosecutors withheld evidence that could be related to the fatal shooting.
“There is no way the court is going to correct this mistake,” Sommer told the court, according to NBC News. “The sanction of dismissal is the only appropriate remedy.” The dismissal was with prejudice, meaning the involuntary manslaughter case against Baldwin could not be refiled, however Morrissey sought to appeal the decision.
movie gunsmith, Hannah Gutierrez-Reedwas found guilty of involuntary manslaughter in March and sentenced to 18 months in prison. Her lawyers’ call for a new trial was denied in September.
