‘Immediate removal’: Trump DHS expands expedited deportation powers as operations ramp up

The Trump administration is significantly expanding its powers to quickly deport illegal immigrants, one of a series of swift actions taken by the administration to make good on its promise to launch a mass deportation operation.

A notice from the Department of Homeland Security, issued Tuesday, removes limits placed on the expedited removal power implemented in March 2022 during the Biden administration. Until the new memo, officials were limited in using the power to within 100 miles of the border or to new arrivals.

Expedited removal allows for the rapid removal of illegal immigrants who have not met the asylum standard or have not applied for asylum. The new power eliminates the 2022 limits, allowing agents to expel those who cannot prove they have lived in the United States for at least two years.

“Currently, immigration officials can apply expedited removal to aliens detained anywhere in the United States up to two years after the alien arrived in the United States, as long as the alien arrived by sea and other conditions have been met. conditions for expedited removal,” the notice, signed by Acting DHS Secretary Benjamine Huffman, said.

“In particular, the full application of expedited removal authority will allow DHS to more effectively and efficiently address the large volume of aliens who are present in the United States illegally, without having been admitted or paroled into the United States, and ensure the prompt removal from the United States of those who have no right to enter, remain, or receive relief or protection from removal,” it says.

The memo arrives a day later. DHS rescinded a Biden-era memo limiting where Immigration and Customs Enforcement (ICE) agents could arrest illegal immigrants. Another memo ordered a review of the use of compassionate parole to admit immigrants.
