Professor presents a complaint against ‘illegal’ discriminatory program

California State University changed a program that was only open to men of color so that it is now open to all students, after a complaint filed before the Office of Civil Rights of the Department of Education.

Cal State, like most universities, has very large bureaucracies dedicated to preventing and remedying discrimination, “said Cornell professor. William Jacobson and founder of the Equal Protection ProjectHe told Fox News Digital. “So, how is it possible that the university as a system participates in open discrimination?”

The complaint, filed on November 19, 2024 by Jacobson and Equal Protection Project, said that 23 Campus of the California State University operated one “Consortium of young males of color

According to the website of the Consortium, it was created to “create systematic changes in higher education and improve the results of black, Latin, Asian men of the Pacific and Native American islands.”

“Because discrimination … is allegedly illegal, and since the CSU cannot show any convincing government justification for this, the exclusions of the CSU system based on race, skin color, national origin and sex violate the federal statutes Civil rights and constitutional guarantees of equal protection, “is stated in the complaint. of the PPE reads.

“The calute system at the highest level needs to investigate how this happened to make sure it does not happen again.” Jacobson said. “A group like mine should not be necessary, a small non -profit organization like mine, to attract attention to this type of problem and solve them. This is something that should self -control. But they apparently did not do it.”

Title IX prohibits discrimination for sex or gender reasons for entities that receive federal funds. Title VI of the Civil Rights Law prohibits discrimination against race, color and national origin in any activity or program that receives federal financing.

The complaint alleges that at least eight of the 23 programs violated title VI and title IX, as “the male success initiative of the CAL Poly San Luis Bishop’s Color Success Success.” The initiative was only open to students who identify themselves as color men.

In the closing letter, the civil rights office said that CSU has changed the consortium to be open to all students.

“The OCR confirmed that, since it filed its complaint, the university made changes in the consortium and its programs/initiatives so that they are open to any student regardless of their race, color, national origin and sex,” reads the letter closing “Because the OCR has obtained credible information that indicates that the accusations have been resolved, the facts underlying the accusations are no longer present and the OCR has no evidence that the law has been violated.”

The California state university system did not respond to a request for comments.

However, Jacobson told Fox News Digital to see if the problem is solved.

“When a school changes the language of a program and opens it to all, are they really doing it?” Jacobson said. “Is this how they practice? Is that what they do when they believe that nobody is looking at them? And that is a great concern because one of the problems we have is that we often feel that we are playing WHO-a-Mole. We break down this program and we ask them to open it and another place appears in another place and take care of that and then another appears in another place. ”

He added that the public plays an important role in supervision and accountability.

“We need people to be alert because you can’t simply accept the letter that a school says: ‘We are no longer going to do that’ and simply assume that they will not do it anymore,” he said. . “So that is what we are trying to do. We are trying to teach universities not to do this and we hope they do not. But we trust that the public let us know if they are not fulfilling their obligations.”
