The governor of California, Gavin Newsom, ordered the State’s probation board to carry out a “comprehensive risk assessment research” In Erik and Lyle Menéndez, To determine if they represent “an unreasonable risk for the public” if it is released from prison.
On Wednesday, Newsom made the announcement during a segment in his podcast, “This is Gavin Newsom.”
“The question for the Board is simple: Erik and Lyle Menéndez represent a current, what we call” unreasonable risk for public safety, “said Newsom.
“The risk assessment will be carried out as experts in public security, as well as forensic psychologists, are conducted by public security experts such as forensic psychologists.”
Newsom described the evaluation as a “common procedure carried out by the State.”
“After that, there will be a hearing that functions as a standard probation hearing, providing the district prosecutor and the victims of the opportunity to be part of the process,” the Governor’s office shared in a statement.
Newsom’s office explained That the legal standard in California for the release of probation is whether an inmate has an unreasonable risk for public security, which must be determined before the governor can make a decision on his switches.
“This process does not mean that there is any guaranteed result, but it shows that we are doing our due diligence, ensuring transparency, maintaining public security at the forefront, ensuring that the process is just for all those involved and approaching a conclusion,” said Newsom’s office.
In November, Newsom indicated that he would postpone any decision on the case of the Menéndez brothers to local courts and prosecutors.
“The governor respects the role of the district prosecutor to ensure that justice is served and recognizes that voters have trusted the elected district prosecutor Hochman to carry out this responsibility.” Said Newsom’s office In a previous statement. “The governor will differ to the review and analysis of the DA-Elect of the Menéndez case before making clemency decisions.”
The Newsom office told Fox News Digital that the governor’s decision is part of a larger advertisement on executive clemency actions that will later launch on Wednesday.
Menéndez Brothers Resentence: What happens next?
The governor of California, Gavin Newsom, asked the State’s probation board to carry out a “risk assessment research” on Erik and Lyle Menéndez, which according to him is a common procedure carried out by the State.
Newsom said that the results of the risk assessment will be shared with the judge of the Superior Court of Los Angeles who preside over the case, as well as the district prosecutor of Los Angeles, Nathan Hochman, and the defense lawyers.
“There is no guarantee of results here,” said Newsom. “My office performs dozens and dozens of these clemency reviews in a consistent way, but this process simply provides more transparency, which I think is important in this case, and provides us with more due diligence before making any determination of clemency.”
Newsom’s announcement occurs less than a week after Hochman asked the Court to reject the request of the Menéndez brothers of a new trial.
Hochman cited problems with evidence, claiming that he did not meet a standard enough for a new trial.
This comes months after the first By George Gascon He cited a new evidence in the form of a letter that suggests that the brothers may have been abused by their father as a reason for a new trial.

“We look again at Letters credibilityParticularly this alleged letter from Andy Cano 1988 heavy in the continuum of lies, and asks a drastic question about whether this is a 1988 letter written by Erik Menéndez to Andy Cano about this sexual abuse, “Hochman said at a press conference on Friday.
The letter was supposedly written eight months before the murders of his parents, José and Kitty Menéndez, in 1989 by Erik Menéndez to his cousin Andy Cano, and detailed the alleged sexual abuse by his father.
The letter was not found until several years ago, said the lawyer of the Menéndez brothers.
The family of the Menéndez brothers condemned Hochman’s decision in a previous statement shared with Fox News Digital for his legal team.
“The District prosecutor Nathan Hochman took us back to 1996 today. He opened the wounds that we have been trying to heal,” the statement said. “He did not listen to us. We are deeply disappointed by his comments, in which he effectively broke a new evidence and discredited the trauma they experienced. Suggesting that the years of abuse could not have led to the tragedy in 1989 is not only scandalous, but also dangerous.

“Abuse does not exist in a vacuum. It leaves lasting scars, it reduces the brain and catches the victims in cycles of fear and trauma. To say that he did not play any role in the action of Erik and Lyle is to ignore decades of psychological research and basic human understanding.”
The statement added that it was “absurd” for Hochman to say that the evidence should have been presented at the trial.
Hochman also pointed out that Newsom has the petition for clemency in his desk and “can do what he wants, whenever he wants, and we will be dealing in the next two weeks with the resentment problem.”
If Hochman’s office continues on the resentment road, Newsom still has the last word. If brothers’ prayers are reduced to something that would make them eligible for probation, the governor has veto power over the decisions of the Board of Probation. You could also emit clemency or forgiveness on your own.
The resentment audience was delayed almost two months due to the devastating forest fires of California.
