But the agency has been blocked to implement policy as challenges play on the court.
The American district judge Angel Kelley, who had issued a temporary restriction order last month, granted a preliminary court order on Wednesday.
“The imminent risk of stopping clinical trials that save life, interrupting the development of innovative medical research and treatment, and the closure of the investigation facilities, without taking into account the current care of the patient, justified the issuance of a temporary restriction order nationwide to maintain the status quo that could be fully approached before the court,” said the judicial document.
“After complete information and the oral argument by the parties, as well as the review of the Amicus accepted writings, the court grants a preliminary judicial order at the national level,” says the document.
After the then president Joe Biden Kelley nominated to serve in the United States District Court for the Massachusetts district in 2021, the Lindsey Graham Republican sensor of South Carolina, Chuck Grassley of Iowa and Susan Collins de Maine voted with the Democrats to confirm the jurist to the role.
