A federal judge appointed by President Donald Trump in 2018 announced that he had resigned from the largest association of federal judges, denouncing how the group issued a rare statement last week condemning the recent alleged threats against the judges, but remained silent for years, while the conservative members of the Judiciary faced the scrutiny and the attack.
Judge James C. HO, of the United States Court of Appeals based in New Orleans for the Fifth Circuit, announced his departure from the Federal Association of Judges during an oratory event on Saturday organized by the conservative federalist society of the Law School of the University of Michigan. It comes in response to the group of 1,100 members issuing a statement on March 5, saying in part that “judges must be able to do their job without fear of violence or intimidation of any kind.” Trump and his allies have become increasing Dux Elon Musk leader Last month he asked for an “immediate wave of judicial judgments.”
“I was very surprised by that statement. And the next morning, I sent an email to the organization saying that I wanted to resign,” Ho said about the Federal Judges Association. “I investigated for myself, and I also asked the association if they ever issued such statements when Judge Thomas received attacks, or Judge Alito. Judge Kavanaugh He tried an attempt to murder. We have had federal district judges in Texas and Florida, as well as, I am sure, other states, but those who come to mind immediately, all faced the type of things that that statement complained and more. Did we see these statements in 2024 or 2023 or 2022? For what I can say, no. ”

“It cannot be said that you are in favor of judicial independence only when it comes to decisions that you like. That does not protect the Judiciary, that is to politicize the Judiciary,” said Ho, arguing that such statements really damage the cause they try more. “Because one of the two things turns out to be true when you are selective in this way. And any of these options, I think, is something bad. The number one option is that you are basically lying, that you do not really care about this principle because you did not defend it when the shoe was on the other foot, so you are essentially saying that the world is not seriously. Committed to judicial independence. “
“The alternative is perhaps even worse, that you are telling the truth: you care about this, this principle, whether judicial independence or freedom of expression. I think this concept applies to many things,” he continued. “If you are telling the truth, you really care about this principle, but there are some people who have points of view that are so anatema for you that you do not think they are worthy of this principle that you expose.”

He began by saying that “recent events are a clear and urgent reminder that federal judges play a crucial role in the defense of our democracy as guardians of the rule of law.”
“In the history of our Republic, there has always been tension between the three separate and equal branches of the federal government, including criticism of judicial interpretations. FJA strives to ensure that precise information is shared with all US citizens regarding the role of the judicial power defined in the constitution of the United States: to impartially interpret the laws that have created the Congress of the United States and with the executive presentation,” the group said. “The specific decisions issued by the judges are not formed from individual opinions, but are prepared against what the ‘laws in books” require. ”
The group praised those, including the president of the Supreme Court, John Roberts, “who have recently commented on the increase in criticism, threats and violence aimed at the members of the Judiciary.”
