In an order on Thursday night, Boasberg criticized the administration after he lost its deadline, saying that “again evaded its obligations” to send the requested information.

Boasberg wrote in his order that the government had sent a statement of six paragraphs from a regional director of the ICE office in Harlingen, Texaswhich notified the court that the cabinet secretaries are “actively considering whether to invoke the privileges of the State Secrets (Act) on the other facts requested by the Order of the Court.”

Boasberg described the “unfortunately insufficient” submission.

Judges Karen Henderson, Patricia Millett and Justin Walker will preside over Monday’s oral arguments. Two of the three judges were nominated for Republican presidentswith Henderson appointed by President George Hw Bush in 1990 and Walker by Trump in 2020.
