Both documents were presented on Friday at the Federal Court of New York before the first hearing of the case, which is scheduled for Monday.

The documents indicated that the metadata integrated in the New York Times article indicated that the departure “had already begun to build its defamatory article at the latest on October 31, 2024”.
The lawsuit stated that “careful observers reported that seeing the HTML source code for the article revealed references to a” message generator “that referred (to a) date of ‘2024-10-31′”. ”

According to the documents, the New York Times created a tool to show Lively texts in the article on October 31, that Baldoni’s legal team suggested that it was evidence that the story was generated for the first time on that date or before.
“It may seem not very surprising and even respectable that a news organization works for weeks or months before publishing an alleged research report,” says the documents.
“But the importance of the moment of these elements of the defamatory article is that they eliminate the legal shields they encourage, the times and the other animated parts probably depended to protect their malicious defamation acts, such as the privilege of litigation and the privilege of fair reports.” .

In a statement to Fox News Digital, Baldoni’s lawyer, Bryan Freedman, addressed the complaint amended.
“The decision to amend our demand was a next logical step due to the overwhelming number of new evidence that has come to light,” Freedman said.

In a statement to Fox News Digital, the representative of the New York Times, Danielle Rhoades Ha, delayed the claims made in the modified demand.
