In March 2023, the Democrats advocated a declaration of transgender rights, proposing A resolution “Recognize that it is the federal government duty to develop and implement a declaration of transgender rights.” The resolution specifically requested the federal law to ensure that biological men can “participate in sports in teams and programs that best align with their gender identity; (and) use school facilities that best align with their gender identity.”
In April 2023, the Biden Department of Education proposed a change of rules that would have punished schools to prevent Trans athletes from competing in women’s sports.
The proposal was entitled “Non -discrimination based on sex in education programs or activities that receive federal financial assistance: sex criteria related to sex for male and female athletic equipment.”

The rule would have prohibited individual states from prohibiting participation in single -sex sports for gender identity instead of sex. There are 23 states in the US that have legislation to restrict Trans athletes as women in public school sports.
In April 2024, Biden issued a rewriting of the radical title IX that issued a prohibition of “sex” discrimination in schools based on gender identity, sexual orientation and “pregnancy or related conditions.” The rule entered into force on August 1 and, for the first time, the law declared that discrimination based on sex includes behavior related to a person’s gender identity.
