A New York appeals court judge on Tuesday rejected a request from the president-elect donald trump to delay your criminal judgment Friday for his conviction in a case involving payment silence money to a porn star before the 2016 elections.
Judge Ellen Gesmer’s refusal came shortly after she held a hearing on Trump’s request, and a day after Manhattan Supreme Court Justice Juan Merchan, who presided over Trump’s trial, refused to delay the sentence.
Trump’s lawyers had argued that Trump was entitled to a stay of the case because of a U.S. Supreme Court ruling last year that said presidents have presumptive criminal immunity for official acts performed in office.
The lawyers also claimed that Trump would suffer irreparable harm and his constitutional rights would be violated if he is sentenced 10 days before he is sworn in for a second term.
Gesmer was skeptical of these claims during the hearing.
“After considering the documents presented and the extensive oral argument, plaintiff’s request for a provisional stay is denied,” the judge wrote in her ruling.
